Ünlü Şef Somer Sivrioğlu, Beşiktaş’taki Restoran Faciasında Hakim Karşısında

Beşiktaş’ta devraldığı restoranın istinat duvarının çökmesi sonucu meydana gelen olayda bir kişinin hayatını kaybetmesi ve bir diğerinin yaralanması nedeniyle ortağı ve mülk sahipleri ile birlikte hakim karşısına çıktı.

Beşiktaş’ta üç ay önce devraldığı restoranın istinat duvarının çökmesi sonucu bir kişinin ölümüne ve bir diğerinin yaralanmasına neden olan ünlü şef Somer Sivrioğlu, ortağı ve mülk sahipleriyle birlikte yargılanıyor. Sivrioğlu, mahkemede verdiği ifadede, istinat duvarının tehlikeli olduğunun dışarıdan anlaşılamadığını ve duvarın restoranın sorumluluk alanında olmadığını düşündüğünü belirtti.

Olayda yaralanarak hayatını kaybeden Ürdün’lu eski diplomat Ahmet Muhammed Salem Lubbad ve yaralanan Baha Eddin Ali Hafez Shanableh’in ailelerinin avukatları, sanıkların bilinçli taksirle hareket ettiklerini iddia ederek Sivrioğlu’nun tutuklanmasını talep etti. Ancak mahkeme heyeti, Sivrioğlu’nun kaçma, delilleri yok etme veya tanıklar üzerinde baskı kurma şüphesi olmadığı gerekçesiyle tutuklanma talebini reddetti.

İstanbul Cumhuriyet Başsavcılığı tarafından hazırlanan iddianamede, sanıkların duvarın ruhsatlandırma, bakım ve onarım işlemlerini yaptırmadan kullanmaya ve kullandırmaya devam ettikleri, bu durumun Baha Eddin Ali Hafez Shanableh’in yaralanmasına ve Ahmad Muhammed Salem Lubbad’ın ölümüne neden olduğu belirtildi. Sanıkların “Bilinçli taksirle ölüme ve yaralanmaya neden olma” suçundan 2 yıl 8’er aydan 22 yıl 6’şar aya kadar hapis cezasına çarptırılmaları talep edildi.

Renowned chef Somer Sivrioğlu, along with partners and property owners, faces trial over an incident where a retaining wall of his newly acquired restaurant in Beşiktaş collapsed, resulting in the death of one individual and the injury of another.

In Beşiktaş, renowned chef Somer Sivrioğlu is on trial along with partners and property owners, following an incident at his newly acquired restaurant where a retaining wall collapsed causing the death of one individual and the injury of another. In his statement to the court, Sivrioğlu mentioned that the dangerous state of the retaining wall was not apparent from the outside, and he believed it wasn’t within the restaurant’s responsibility as it was located a meter away from the restaurant premises. He assumed it was under the municipality’s jurisdiction.

The fatal incident involved former Jordanian diplomat Ahmet Muhammed Salem Lubbad and Baha Eddin Ali Hafez Shanableh, who were passing by when the wall collapsed. The attorney representing the families of Lubbad and Shanableh claimed that the defendants acted with conscious negligence and demanded the arrest of Sivrioğlu. However, the court board rejected the arrest demand, stating that there was no suspicion of Sivrioğlu fleeing, destroying evidence, or exerting pressure on witnesses.

According to the indictment prepared by the Istanbul Chief Public Prosecutor’s Office, the defendants continued to use and allow the use of the wall without carrying out the necessary licensing, maintenance, and repair procedures, leading to the injury of Baha Eddin Ali Hafez Shanableh and the death of Ahmad Muhammed Salem Lubbad. It’s demanded for the defendants to be sentenced to imprisonment ranging from 2 years and 8 months to 22 years and 6 months each for “causing death and injury by conscious negligence”.
